* The discrepancy in the final pending count for the Annual FOIA Report for Fiscal Year 2005 and the beginning count for the Fiscal Year 2006 report is due to the transfer of data from one tracking database to the current redacting and tracking systm. Reconciliation of this data is still an ongoing process.
** Last year's annual report reflects that EOUSA had 1,706 pending requests at the end of Fiscal Year 2005. In past years, the number of requests EOUSA reported as pending never fully accounted for requests received during the year. Since EOUSA has automated its annual report, it is now able to generate more accurate data.
*** In Fiscal Year 2005, all FOIA requests received at the Department of Justice (DOJ) Mail Referral Unit were counted in the JMD report. This included requests that were referred to other DOJ components, as well as to agencies outside the DOJ. Beginning in the Fiscal Year 2006 report, JMD is counting only those FOIA requests that were transferred to other federal agencies. FOIA requests that are referred within the DOJ are counted by the components that process the requests. In addition, in Fiscal Year 2005, an error was made in listing 169 FOIA requests from the Mail Referral Unit as pending, because these 169 FOIA requests actually had been referred within the Department. This adjusts the number of requests pending at the end of Fiscal Year 2005 to 32.
**** In addition, JMD's Mail Referral Unit assisted FOIA requesters in 187 instances by either forwarding their requests or informing them of the appropriate federal agency to handle their requests.
