State & Local Officials

CPSC looks to the states and counties, including state and local health departments, to assist us in enforcing the requirements of the Pool and Spa Safety Act (P&SSAct). Both the CPSC and State Attorneys General are empowered to enforce the Act. States have the authority to enforce the requirements of the Act, but states are not required to do so.

State and local officials in various agencies in most states regulate and inspect public pools and spas. State or local law can be more restrictive than the federal law as long as the state or local law does not make complying with the P&SSAct a physical impossibility. CPSC has partnered with state and local agencies to assist with compliance inspections and encourages others to become involved. Contact PoolSafely@cpsc.gov to learn more about these contracts.

Like CPSC, state and local officials share the federal government’s concern about the tragic toll drownings, submersion injuries and entrapments take on American families every year. Nearly 400 children under the age of 15 die annually in pool- and spa-related drownings, and another 4,200 are treated for submersion injuries. Only through a coordinated effort on the local, state and federal levels can we reduce drownings, submersion injuries and entrapments.
