On March 21, 2011, Mr. Timothy J. Feighery was sworn in as the Chairman of the Foreign Claims Settlement Commission. He was nominated for the position by President Obama on November 15, 2010, and confirmed by the Senate on March 10, 2011.

Prior to his appointment, Chairman Feighery served as an Attorney Adviser in the Office of the Legal Adviser at the U.S. Department of State, where he defended U.S. interests in international arbitration and foreign investment disputes. From 2003 to 2004, Mr. Feighery was a Deputy Special Master for the September 11th Victim Compensation Fund of 2001, where he was responsible for assessing claims for compensation by victims of the 9/11 attacks. Prior to that, he served as a Team Leader (1996-1998), and later became Chief of Section of the Legal Services Branch (2000-2003) of the United Nations Compensation Commission in Geneva, established to address claims arising out of Iraq’s 1990 invasion and occupation of Kuwait. Previously, Mr. Feighery worked as a Senior Attorney in the Bureau of Competition at the Federal Trade Commission and as an Associate at Kaye Scholer LLP. Mr. Feighery served as Co-Vice Chair of the American Bar Association Committee on International Courts and has also taught as an Adjunct Professor at the George Mason University School of Law and Webster University in Geneva, Switzerland. Mr. Feighery holds a B.A. and J.D. from Fordham University. He and his wife Sarah have three children.

On May 28, 2008, Mr. Rafael E. “Ralph” Martinez was sworn in as a part-time Commissioner of the Foreign Claims Settlement Commission. He was nominated for the position by President Bush on February 7, 2008, and confirmed by the Senate on May 20, 2008.

Commissioner Martinez is currently the managing partner of McEwan, Martinez & Dukes, P.A. In 2003, Mr. Martinez was nominated by the President of the United States to serve as a public delegate, representing the United States before the United Nations 57th General Assembly. On May 23, 2003, he was confirmed by the U.S. Senate and served as a public delegate for that term.

Mr. Martinez was admitted to practice in Florida by the Florida Supreme Court in 1977; Mr. Martinez has actively practiced civil litigation for the past 30 years in Florida, and was admitted to practice before the U.S. Supreme Court in 1981. Mr. Martinez maintains an A.V. Martindale-Hubbell rating.

Mr. Martinez is active in Bar–related organizations having served as a member of the Ninth Circuit Judicial Nominating Commission (1990–1994; Commission Chair, 1993–1994); Fifth District Court of Appeals Judicial Nominating Commission (1995–1999), Orange County Bar Association, Professionalism Committee Chairman (1999–2000), Judicial Relations Committee Chairman (1997–1998); American Board of Trial Advocates (ABOTA) Central Florida Chapter (1996 – Present; President, 2004); International Association of Defense Counsel; Products Liability Committee (1996–Present), Pharmaceutical Medical Device and Biotechnology Committee (1996–Present), Medical Defense Committee Chair (2000–2001); IADC Trial Academy, Faculty; Stanford University (2004); Board of Directors of the Health Law Section of the Florida Bar (1992–1997); Inter–American Bar Association (1979–Present); Fellow of the American Bar Foundation.

He received his Bachelor of Science degree from the University of Florida in 1973, and his Juris Doctorate degree from Florida State University in 1976. He and his wife Rebecca E. Martinez have three children.

On April 6, 2012, Mr. Anuj C. Desai was sworn in as a part-time Commissioner of the Foreign Claims Settlement Commission.  He was nominated for the position by President Obama on April 8, 2011, and confirmed by the Senate on March 30, 2012.

Commissioner Desai is an Associate Professor of Law at the University of Wisconsin Law School.  He has also taught as a visiting professor at the Johns Hopkins University-Nanjing University Center for Chinese and American Studies in Nanjing, China; National Taiwan University in Taipei, Taiwan; and National Tsing Hua University in Hsinchu, Taiwan.  Prior to joining the University of Wisconsin faculty in 2001, Professor Desai practiced law with the Seattle, Washington firm of Davis Wright Tremaine LLP.  Before his time in private practice, he served as a legal assistant to the American arbitrators at the Iran-United States Claims Tribunal in The Hague, The Netherlands, and as a judicial law clerk for the Honorable David S. Tatel at the United States Court of Appeals for the D.C. Circuit and the Honorable Louis F. Oberdorfer at the United States District Court for the District of Columbia.  He also worked briefly in the Legal Adviser’s Office at the U.S. Department of State and at the Legal Resources Centre in Grahamstown, South Africa. 

Commissioner Desai earned an A.B. in Mathematics from Harvard University, where he was awarded a Henry Russell Shaw Fellowship, a Master’s in International Affairs from Columbia University and a J.D. from the University of California, Berkeley (Boalt Hall) School of Law, where he was Editor-in-Chief of the California Law Review.
