Alcohol Regulation

The Commission and its staff have considerable experience in analyzing the competitive impact of regulations affecting the alcoholic beverage industry. As part of its competition advocacy efforts, FTC staff has provided to state legislators analyses of various proposed restrictions on the vertical relationships between alcoholic beverage producers and wholesalers. Staff also has extensively analyzed the effects of bans on wine direct shipping. In 2003, staff issued a comprehensive report – based on extensive workshop testimony and staff’s own empirical research – on the adverse competitive effects of wine direct shipping bans. Most recently, in response to requests from state legislators, staff has commented on proposed legislation involving the direct shipment of wine in New York, Ohio, and Florida.
