Importing and Exporting Hazardous Waste

The import-export program controls international trade in hazardous waste for the United States. The United States is a party to various international agreements, including those with Canada and Mexico, which provide for prior notification of shipment of wastes (i.e., both importing and exporting of wastes). EPA has issued regulations under the Resource Conservation and Recovery Act (RCRA) which are binding on the regulated community. The program processes notifications; collects from the United States Bureau of Customs and Border Protection export manifests documenting individual shipments of waste; and receives export annual reports from the regulated community. The program also assists in developing and handling international and border aspects of civil RCRA enforcement matters.

International Trade in Hazardous Waste: An Overview (PDF) (EPA 305-K-98-001/November 1998) (5 pp, 33K). This brochure presents an overview of the import/export program in the hazardous waste area. It presents basic concepts and information and is a user friendly introduction to the program.

Transboundary Movement of Hazardous Waste and Border Security (PDF) (121 pp, 660.6K) Transcript of Joint U.S.-Canada Industry Workshop, March 5-6, 2003, which dealt with the laws and policies governing the import and export of hazardous waste and border security issues. Participants included officials from both countries.

Criteria and Process for Denial of Requests to Import Waste to a U.S. Facility (PDF) (6 pp, 491K) This memorandum identifies the criteria which EPA considers in deciding whether to object to a notification of intent to import foreign hazardous wastes to a U.S. facility. This memorandum also establishes the procedures U.S. facilities should follow to respond to a denial of their request to import that waste.
