Pesticide News Story: EPA Finalizes Rule that Clarifies Microbial Pesticides Data Requirements and Announces Availability of a Final Test Guideline

The EPA is announcing final clarifications and corrections to the Microbial Pesticides Data Requirements (40 CFR part 158, subpart V), and the availability of a final test guideline for microbial pesticides. These minor revisions are part of ongoing efforts by EPA to constantly improve the pesticide registration process and are expected to enhance the ability of industry to efficiently manage its microbial pesticide registration submissions, and minimize unnecessary burdens.
The changes to the Microbial Pesticides Data Requirements do not create additional regulatory requirements. Rather, the revisions include several minor corrections to words and references that had been confusing to the regulated and stakeholder communities. Additionally, regulatory language has been clarified regarding requirements for new microbial isolates that are considered to be new active ingredients under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA).
The EPA is also announcing the availability of a final test guideline that clarifies an existing data requirement for applicants of microbial pesticide products and experimental use permits. The guidance pertains to applicants depositing samples of their microbial active ingredients in any nationally recognized culture collection. Test guidelines serve as a compendium of accepted scientific methodologies and protocols that are intended to provide guidance for conducting tests and gathering data that will inform and support regulatory decisions.
