“I am always pleased when South Carolinians can recoup a portion of their losses when securities violations have occurred,” said South Carolina Attorney General and Securities Commissioner Alan Wilson. “This distribution is possible due to the strong degree of cooperation and effort put in by the South Carolina Securities Division and other securities agencies across the country. This case is a prime example of how securities enforcement should be conducted.”

People also should be aware of the rush of solicitations that follow a highly publicized natural disaster or other crises. “There will be fraudulent charity solicitations,” Wilson said.” Some will be looking for your money; some will be attempting to steal your credit card information for identity theft. As with any charitable contribution, people wanting to help with relief efforts following Sandy should send contributions to only those charities with an established track record.”

On September 30, 2012, a Berkeley County Sheriff’s Office undercover detective downloaded two files containing child pornography. On October 22, 2012, sheriff’s deputies executed a search warrant at Pearson’s residence. Pearson admitted he had “downloaded some questionable material.” Three laptop computers, several computer hard drives, several flash memory cards, CD’s and DVD’s and associated electronic equipment were seized from the residence.

Berkeley County Sheriff’s Office undercover detective downloaded five video files from the suspect’s computer which were available for public access and were shared using a file-sharing program. All five files contained child pornography as defined by South Carolina state law.

Arrest warrants allege that between July and August 2012, Spivey, while using the fictitious name “Chris Stephens”, sent a 13 year-old girl messages stating he wanted to perform sexual acts on the victim, asking the victim for intercourse, and sent a sexually explicit picture of himself to her.

The City of Anderson Police Department is a member of the state’s Internet Crimes Against Children Task Force. Task Force investigators have received training on the use of special software to conduct undercover investigations related to the possession of child pornography on peer-to-peer (file sharing) networks.
