Definition of Unjustified or Unwarrented Personnel

Unjustified or Unwarranted Personnel Action means an act of commission or omission that an appropriate authority determines, on the basis of substantive or procedural defects, to have been unjustified or unwarranted under applicable law, Executive Order, rule, regulation, or mandatory personnel policy established by FAA or through a collective bargaining agreement. An action may include personnel actions and/or pay actions.

Unwarranted or unjustified personnel action means an act, or failure to act, that an appropriate authority determines violates an applicable--
- law,
- Executive Order,
- regulation, or
- mandatory personnel policy established by the FAA or through a collective bargaining agreement.
This term also applies to an act, or failure to act, that affects an employee's pay.
