Notice to Readers

The versions of 34 C.F.R. Parts 100, 104, and 110 linked from this page incorporate the amendments made in the notice of Final Regulations published in the Federal Register on November 13, 2000 (65 Fed. Reg. 68050), and effective on December 13, 2000.  These amended regulations are also available in the current edition of the Code of Federal Regulations at Title 34. If there is a discrepancy between the Code of Federal Regulations and the versions of 34 C.F.R. Parts 100, 104, and 110 linked from this page, the Code of Federal Regulations prevails.

In addition, the version of 34 C.F.R. Part 106 linked from this page incorporates the amendments made in the notice of Final Regulations published in the Federal Register on November 13, 2000 (65 Fed. Reg. 68050), and effective on December 13, 2000, and the amendments made in the notice of Final Regulations published in the Federal Register on October 25, 2006 (71 Fed. Reg. 62529), and effective on November 24, 2006.  The amended regulations are also available in the current edition of the Electronic Code of Federal Regulations at Title 34. If there is a discrepancy between the Electronic Code of Federal Regulations and the versions of 34 C.F.R. Part 106 linked from this page, the Electronic Code of Federal Regulations prevails.

Neither the November 13, 2000 Federal Register Notice nor the October 25, 2006 Federal Register Notice made conforming changes to Appendix B to Part 100, Appendices A and B to Part 104, Appendix A to Part 106, and the Index to Part 106. Thus, these documents are not contained in these versions of the regulations.

28 C.F.R. Part 35 is enforced by the U.S. Department of Justice. The U.S. Department of Education is designated by the U.S. Department of Justice to resolve complaints alleging noncompliance with this part against public elementary and secondary education systems and institutions, public institutions of higher education and vocational education (other than schools of medicine, dentistry, nursing, and other health-related schools), and public libraries. On September 15, 2010, the U.S. Department of Justice published a final rule revising the regulations implementing Titles II and III of the Americans with Disabilities Act (75 Fed. Reg. 56163).  The amendments are effective on March 15, 2011.
