Normas Relacionadas con las Llamadas Telefónicas de Mercadeo

En un esfuerzo por afrontar el creciente número de llamadas telefónicas de mercadeo, el Congreso aprobó en 1991 la Ley de Protección al Consumidor de Servicios Telefónicos (TCPA, por sus siglas en inglés). La TCPA restringe las llamadas telefónicas de mercadeo y el uso de sistemas de marcadores automáticos y de mensajes artificiales o pregrabados. Las normas son aplicables a las operadoras de servicios de telecomunicaciones, así como a otros vendedores. En 1992, la Comisión adoptó normas para implementar la TCPA, incluyendo el requisito de que las entidades que hagan llamadas telefónicas de promoción establezcan procedimientos para confeccionar listas de No llamar en las que figuren determinadas compañías.

El 3 de julio de 2003, la FCC revisó las normas de la TCPA para establecer, en coordinación con la Comisión Federal de Comercio (FTC, por sus siglas en inglés), un Registro “No llamar”. El registro nacional abarca todo el país, a todos los televendedores (con excepción de determinadas organizaciones sin fines de lucro), y es aplicable tanto a las llamadas interestatales como intraestatales. El registro entró en vigor el 1ro de octubre de 2003 y lo administra la FTC. Para reducir el número de llamadas “colgadas” y “muertas” que experimentan los consumidores, las normas de la Comisión sobre las llamadas telefónicas de mercadeo también contemplan restricciones en relación con el uso de marcadores automáticos, así como requisitos para transmitir información a los identificadores de llamadas.
