I am at an event, restaurant, or other public place and a band or the radio is playing in the background but I do not intentionally record the band or radio. I am filming something else. The music is out of my control. Is this fair use?

A movie was filmed in my city a few years ago. I want to film some of the filming location to show people where each scene was filmed. I want to place small clips of the movie side-by-side with my video. Is this fair use?

  • Ultimately, Youtube doesn't care about whether something is "used fairly," only the power and wealth of the individua/corporation making the claim. If it's a major studio then Youtube's goons practically trip over themselves taking down the "offending" material no matter how fairly it was actually used. It's not the law that matters on youtube when it comes to copyright, but the relative power of those involved. If you have it you can do almost anything and if you don't you're just screwed.

  • Hi, I made a film which includes some movie quotes and I'm using it to teach English, based on the language they use. Would this fit into fair use? I actually thought it did and then posted it, but It was blocked.
