Tips for Describing Records Requested Under FOIA

In order to help expedite the search process, CBP FOIA has provided some tips that may assist with the FOIA requests.

Request/Record TypeTips on how to describe and submit the request
ApprehensionPlease note that Border Patrol agents are responsible for the apprehension of individuals attempting to illegally enter the United States between ports of entry while CBP Officers located at ports of entry are responsible for the processing of individuals who are seeking admission at an official port of entry. Identifying the type of interaction you had with CBP may help in locating records.

Being as specific as possible helps CBP to process your request quickly, and since apprehensions sometimes result in either an expedited removal or a voluntary return, you may want to request those records also. For example:

I was apprehended on [Month Day, Year].

I am requesting my expedited removal documents from [Month Day, Year]. I was banned for [5, 10, or 20] years.

I am requesting my records pertaining to an illegal/attempted entry that resulted in a voluntary return in or around [location] approximately in [Year].

Background Investigations/Periodic Re-InvestigationThese records pertain to applicants, employees or contractors with CBP. Please provide the name the investigation was conducted under, including your maiden name, if applicable. For example: The background investigation or periodic re-investigation lists my name as _________ and my maiden name is _________.
Expedited RemovalPlease provide specific dates pertaining to the expedited removal records. For example: I am requesting my expedited removal documents from [Month Day, Year]. I was banned for [5, 10, or 20] years.
Human Resources (Personnel)Be specific as possible regarding the certificates and documents you want, including the vacancy announcement number/duty location, if applicable. For example: I am requesting my records pertaining to ______ in or around [location] approximately on [Month Day, Year]. The vacancy announcement is _______ and the duty location is ____.

I-94 RecordI am seeking information regarding an I-94 record that reflects my arrival to the United States on (Month, Date, and Year) at (port of entry). If you used a different name or date of birth, you must include this information.

Misconduct (Alleged)Provide as much information as you can (i.e. timeframe, specific issue/incident/event, date and place of interview, etc.). For example: I am requesting my records pertaining to ___ in or around [location] approximately on [Month Day, Year].
Records Regarding Processing at a Port of Entry I am seeking records regarding the inspection or examination process I experienced when I arrived in the United States on (Month, Date, and Year) at (airport, land port of entry, other official port of entry). I experienced (describe what happened: delay, return to my home country, etc.).
Information Regarding Entry and ExitBe sure to include whether or not you entered legally or illegally, and provide specific time frames. For example: I am requesting my entry/exit documents from [Month Day, Year].
Voluntary ReturnProvide specific dates pertaining to the voluntary return. For example: I am requesting my records pertaining to an illegal/attempted entry that resulted in a voluntary/involuntary return in or around [location] approximately in [Year].
ContractsIf you are seeking a copy of a contract, you must provide either a valid solicitation or contract number. These can be found at Federal Business Opportunities, the Federal Procurement Data System ( FPDS ) or ( USAspending.gov ) . In addition to including the contract/solicitation number, please include the common title of the contract or service being provided by the contract. Please note that total contract values or lists of contracts by geography, industry, etc., are available at ( USAspending.gov ) (using the “advanced search” function). Also, please be advised that many contracts and task orders are made available to the public at no charge on the CBP Reading Room/Library [insert link]. You may find the responsive documents by clicking on the “Contracts” link and then searching for the full contract/task order number (including the “HSBP” prefix).
