                BOISE – U.S. Attorney Wendy J. Olson announced today that Bodybuilding.com LLC and Jeremy DeLuca, former president and vice president of Bodybuilding.com LLC, were charged by information on Tuesday with misdemeanor violations of the Food, Drug and Cosmetic Act.

     

                The defendants have entered into plea agreements, pursuant to which they will plead guilty to the charges and pay a fine. According to the agreements filed with the district court, Bodybuilding.com will pay a $7 million fine, and Jeremy DeLuca will pay a $600,000 fine. The plea hearings are set for May 24, 2012, before U.S. Magistrate Judge Candy Dale. A plea is not binding until entered in court.

     

                The case was investigated by the Food and Drug Administration, Office of Criminal Investigations.
