Inauguration 2009 Sermons and Orations Project

Participant Release Form

I, _____________________________________________, am a participant in the Inauguration 2009 Sermons and Orations Project, which is sponsored by the American Folklife Center at the Library of Congress. I understand that the purpose of the project is to collect audio and video recordings and/or printed texts of sermons and orations, delivered around the time of the inauguration of Barack Obama as the President of the United States, that make prominent reference to this historic event. I further understand that a purpose of the project is to include these texts and audio and video recordings in the permanent collections of the Library of Congress, where they will constitute a record of Americans’ reflections on the significance of the inauguration that can serve as a scholarly and educational resource for Congress, scholars and the general public.

I understand that the Library of Congress plans to retain the product of my participation in the project, including, but not limited to, audio and/or video recordings of one or more sermons delivered by me, the text of the sermon or sermons I delivered, photographs, statements, name, images or likeness, voice, and written materials (“My Collection”) as part of their permanent collections. A copy of My Collection may also be deposited at the National Museum of African American History & Culture at the Smithsonian Institution (Smithsonian).

I hereby grant to the Library of Congress ownership of the physical property comprising My Collection. Additionally, I grant the Library of Congress and the Smithsonian, at no cost, the perpetual, non-exclusive, transferrable, worldwide right to use, reproduce, transmit, display, perform, prepare derivative works from, distribute, and authorize the redistribution of the materials in My Collection in any medium. By giving this permission, I understand that I retain any copyright and related rights that I may hold.

I hereby release the Library of Congress and the Smithsonian, and their assignees and designees, from any and all claims and demands arising out of or in connection with the use of My Collection, including but not limited to any claims for copyright infringement, defamation, invasion of privacy, or right of publicity.

Should any part of My Collection be found to include materials that the Library of Congress deems inappropriate for retention with the collection or for transfer to other collections, the Library of Congress may dispose of such materials in accordance with its procedures for disposition of materials not needed for their collections.
