Rights and Restrictions Information

There are no restrictions known to the Library on the use of images with original negatives, with the exceptions noted below. Photographic prints for which the Library does not hold negatives may have been produced as "work for hire" and copyright may be held by the original client. Privacy and publicity rights may apply.

Access: Permitted; subject to P&P policy on serving originals.

Reproduction (photocopying, hand-held camera copying, photoduplication and other forms of copying allowed by "fair use"): Permitted, with the exception of the King Ranch photographs (see below); subject to P&P policy on copying. This policy prohibits xeroxing of the original photographs in this collection.

Publication and other forms of distribution:

Images for which the Library holds original negative: Per the instrument of gift, Miss Frissell dedicated to the public the rights she held to original negatives in her collection, and she orally informed the Library that she held the rights to those images. This assertion is supported by Vogue Magazine, for which Miss Frissell was a staff photographer from 1933 to the late 1940s. They have informed the Library in writing that they claim no rights to images for which the Library holds the negatives. However, privacy and publicity rights may apply.

The presence of one of the following codes at the beginning of a reproduction number indicates that the Library holds the original negative:

LC-F9-03-... LC-F9-53-...
LC-F9-04-... LC-F9-54-...
LC-F9-11-... LC-F9-56-...
LC-F9-30-...  

Note: Photographs in LOT 12452, Bookboards, which have original negatives fall into the above category. Photographs of Bouvier-Kennedy wedding in LOT 10499-2 also have original negatives. They represent a portion of an exhibition created by Magnum, Inc., for the Library in 1964 from negatives to which Miss Frissell retained rights. Magnum does not control use of original Frissell negatives in the Library's collection.

Images for which the Library does not hold the original negative: Photographic prints for which the Library does not hold negatives may have been produced as "work for hire" and copyright may be held by the original client. Privacy and publicity rights may also apply.

Note: Photographs in LOT 12452, Bookboards, which do not have original negatives fall into this category.

King Ranch photographs: Written permission must be received before photographic copies of King Ranch images can be produced for any purpose. Contact:
