Federal Register Notice Seeking Applications for the Commission's Practitioners Advisory Group. Because a voting membership of the Practitioners Advisory Group has become vacant before the expiration of the term, the Commission is seeking applications to fill the vacancy. The voting membership covered by this notice is the circuit membership for the Sixth Circuit. The individual appointed would complete the remainder of the unexpired term, which expires as of October 2014. Federal Register Notice of Final Action Regarding Amendment on Retroactivity, Effective November 1, 2011. The Sentencing Commission hereby gives notice of an amendment to a policy statement and commentary made pursuant to its authority under 28 U.S.C. § 994(a) and (u). The Commission promulgated an amendment to Policy Statement §1B1.10 (Reduction in Term of Imprisonment as a Result of Amended Guideline Range) clarifying when, and to what extent, a sentencing reduction is considered consistent with the policy statement and therefore authorized under 18 U.S.C. § 3582(c)(2). Notice of a Temporary, Emergency Amendment to Sentencing Guidelines and Commentary, Effective November 1, 2010. The Commission hereby gives notice of a temporary, emergency amendment to the sentencing guidelines and commentary, made pursuant to section 8 of the Fair Sentencing Act of 2010, Pub. L. 111-220. This notice sets forth the temporary, emergency amendment and the reason for amendment. The Commission has specified an effective date of November 1, 2010, for the emergency amendment, which will be incorporated into a forthcoming supplement to the Guidelines Manual.
Proposed Amendment and Issues for Comment: Fair Sentencing Act of 2010. The Commission is seeking comment on its emergency, temporary proposed amendment and issues for comment implementing the statutory changes regarding crack cocaine offenses and directives regarding drug trafficking offenses generally set forth in the Fair Sentencing Act of 2010 (Pub. L. No. 111–220). The Act was signed into law on August 3, 2010, and requires the Commission to promulgate its emergency, temporary amendment (pursuant to section 21(a) of the Sentencing Reform Act of 1987 (28 U.S.C. §994 note)) within 90 days, i.e., not later than November 1, 2010. Federal Register Notice of Request for Public Comment. On April 29, 2010, the Commission submitted to the Congress amendments to the sentencing guidelines and official commentary, which become effective on November 1, 2010, unless Congress acts to the contrary. Such amendments and the reasons for amendment subsequently were published in the Federal Register (75 FR 27388, May 14, 2010). One of the amendments, specifically Amendment 5 pertaining to the use of recency as a factor in the calculation of the criminal history score, has the effect of lowering guideline ranges. The Commission requests comment regarding whether that amendment should be included in subsection (c) of §1B1.10 (Reduction in Term of Imprisonment as a Result of Amended Guideline Range (Policy Statement)) as an amendment that may be applied retroactively to previously sentenced defendants. Section 995(a)(1) of title 28, United States Code, authorizes the United States Sentencing Commission to establish general policies and promulgate rules and regulations as necessary for the Commission to carry out the purposes of the Sentencing Reform Act of 1984. The Victims Advisory Group is a standing advisory group of the Commission. Federal Register Notice of Final Action Regarding Amendments on Retroactivity, Effective March 3, 2008. The Commission hereby gives notice of amendments to a policy statement and commentary made pursuant to its authority under 28 U.S.C. § 994(a) and (u). (This notice will be published in a forthcoming edition of the Federal Register.) On December 11, 2007, the Commission promulgated an amendment to policy statement §1B1.10 [Reduction in Term of Imprisonment as a Result of Amended Guideline Range (Policy Statement)] clarifying when, and to what extent, a sentencing reduction is considered consistent with the policy statement and therefore authorized under 18 U.S.C. § 3582(c)(2).
On December 11, 2007, the Commission also promulgated an amendment to policy statement §1B1.10 that designates Amendment 706, as amended by Amendment 711, (pertaining to to crack cocaine offenses) for inclusion in subsection (c) as an amendment that may be applied retroactively.

The amendments in this Federal Register Notice of Final Action do not take effect until March 3, 2008. Until that date, the court should apply § 1B1.10 as it exists in the Guidelines Manual effective November 1, 2007.
Federal Register Notice of Public Hearing. The Commission has scheduled a public hearing for November 13, 2007 at Georgetown University Law Center, Gerwirz Student Center, Twelfth Floor Conference Room, 120 F Street, NW, Washington, DC at 9:30 a.m., regarding whether Amendment 9 pertaining to offenses involving cocaine base ("crack") and Amendment 12 pertaining to certain criminal history rules, see 72 FR 28558 (May 21, 2007); 72 FR 51882 (September 11, 2007), should be applied retroactively to previously sentenced defendants. Requests to testify should be received by the Commission not later than October 29, 2007. Written testimony for the public hearing must be received by the Commission not later than November 5, 2007.
