Genetic Information Nondiscrimination Act of 2008

The Civil Rights Division has the authority to enforce Title II of the Genetic Information Nondiscrimination Act of 2008 (GINA) against State and Local government employers. Title II of GINA prohibits the use of genetic information in making employment decisions, restricts acquisition of genetic information by employers and other entities covered by Title II of GINA, and strictly limits the disclosure of genetic information.

Complaints should be filed with the Equal Employment Opportunity Commission (EEOC).

GINA went into effect on November 21, 2009.

Information about this new law is available from the EEOC’s Website at: http://www.eeoc.gov/laws/types/genetic.cfm.
