PPP Authorities

The basis on which the National Institutes of Health (NIH) engages in public-private partnerships is precisely the same as for all other NIH activities.

• No new public-private partnership (PPP) authority (!)
  • PPPs represent “business as usual”
  • Official Duty Activity – interacting with partners is one of the means by which NIH accomplishes its public health research mission. These are, therefore, official duty activities, NOT outside activities for NIH staff members.
• Authorities relevant to PPPs: Among the authorities that facilitate PPPs are NIH’s ability to accept gifts and to work in concert with foundations.

  • Unrestricted gifts
• Foundation for NIH and/or other foundations serve as uniquely helpful partners in PPPs in the following situations:
  • When co-equal governance is appropriate
  • When a donor represents a prohibited source or seeks distance from the work to be supported with the donation
