State-Specific Threshold Proposals

The Rate Increase Disclosure and Review Final Rule (45 CFR Part 154) provides for a single, national 10 percent threshold to be applied for the first year of the rate review program to designate proposed rate increases that are subject to review.  The regulation allows for state-specific thresholds to be established thereafter.  The Secretary will issue notice of any such thresholds by June 1 of each year and the state-specific thresholds will apply for a 12-month period beginning on September 1 of the year in which they are announced.  In States where no state-specific threshold is established, the 10 percent review threshold will continue to apply.

Guidance entitled “State-Specific Threshold Proposals, Guidance for States” was issued on March 27, 2012, and outlined the process to be followed by States wishing to propose a state-specific threshold.  Proposals are due May 1, 2012.  Below is a list of States that are proposing a state-specific threshold. Materials related to the proposal will be posted here.

Interested parties wishing to comment on a State proposal may do so by submitting comments by email to: ratereview@cms.hhs.gov; or by regular mail. Comments are due May 15, 2012.
