DEPUTY SECRETARY OF COMMERCE

SECTION 1. PURPOSE.

.01 This Order prescribes the scope of authority and the duties and responsibilities of the Deputy Secretary of Commerce (the Deputy Secretary).

.02 This revision establishes a performance oversight unit in the office of the Deputy Secretary.

SECTION 2. STATUS AND LINE OF AUTHORITY.

.01 The position of Deputy Secretary of Commerce was established by Section (2)(b)(1) of Reorganization Plan No. 3 of 1979 and Executive Order 12175 of December 7, 1979. The Deputy Secretary is appointed by the President by and with the advice and consent of the Senate, at Level II of the Executive Schedule, and performs such duties and exercises such powers as the Secretary may from time to time prescribe.

.02 The Deputy Secretary shall perform the duties of the Secretary as Acting Secretary in case of the absence or incapacity of the Secretary and in case of a vacancy in the Office of the Secretary.

SECTION 3. DELEGATION OF AUTHORITY.

Pursuant to the authority vested in the Secretary by law, and subject to such policies and directives as the Secretary may prescribe, the Deputy Secretary is hereby delegated the authority of the Secretary to serve as a member of the Emergency Steel Loan Guarantee Board and the Emergency Oil and Gas Guaranteed Loan Board, as established in Public Law 106-51, the Emergency Steel Loan Guarantee and Emergency Oil and Gas Guaranteed Loan Act of 1999.

SECTION 4. DUTIES AND RESPONSIBILITIES.

.01 The Deputy Secretary shall serve as the principal deputy to the Secretary in all matters affecting the Department of Commerce (the Department). In this capacity, the Deputy Secretary will perform continuing and special duties as the Secretary may assign from time to time, including, as may be specified by the Secretary, the day-to-day management of the Department and the exercise of policy direction for and general supervision of organization units and personnel not placed under other Secretarial Officers.

.02       The Deputy Secretary shall be assisted in carrying out these responsibilities by a
 performance oversight unit that works collaboratively with other Departmental offices and the operating units.

SECTION 5.  EFFECT ON OTHER ORDERS.

This Order supersedes Department Organization Order 5-1, dated August 20, 2004.
