Verifying New Employees on Form I-9

All new employees must complete Form I-9, Employment Eligibility Verification, regardless of whether they are assigned to a federal contract. Employers are required to comply with Form I-9 requirements. As an E-Verify employer, you have additional employment verification requirements for Form I-9 that other employers do not have:

  • If an employee chooses to present any List B document, you may only accept a document that contains a photo.
  • You must make a photocopy of any Employment Authorization Document (Form I-766) or a Permanent Resident Card (Form I-551) when your employee chooses to present one of these documents and keep it with the employee’s Form I-9.
  • Your employees must write their Social Security number (SSN) on Section 1 of Form I-9. If the employee has applied for but has not yet received his or her SSN, you must note this on the employee’s Form I-9 and run the employee’s E-Verify case using the SSN as soon as it becomes available. 

Verify Existing Employees Using Form I-9

In order to comply with the Federal Acquisition Regulation (FAR) rule, you must verify all new hires and existing employees assigned to the federal contract. You may exceed those requirements of the rule and verify your entire workforce. When you choose this option, you must decide how you will verify your entire workforce. 

  • Only those employees assigned to the contract 
  • Your entire workforce

You must also determine which employees are exempt from the Form I-9 process.


You must decide how you will verify your existing employees’ information on their Form I-9, by doing one of the following:

  • Complete new Forms I-9 for your existing employees, or
  • Update your employees’ existing Forms I-9.
