E-Verify Notices and Letters

E-Verify notices and letters provide employees with important information and instructions related to tentative nonconfirmations (TNC) and how to resolve them.

The TNC process involves two documents:

  • Notification to Employee of Tentative Nonconfirmation (called a TNC notice)
  • Referral Letter

The TNC notice and referral letter will be prepopulated with the employee’s information as it was entered into E-Verify. The employer and the employee should review the documents together to ensure the prepopulated information is accurate.

The TNC notice link appears when an employee receives a TNC. The employer must select the language of the notice (English or Spanish), print and give the notice to the employee.  The TNC notice explains the reason for the TNC and the employee’s right to contest it.

The referral letter link appears after the employer has indicated that the employee has been notified of the TNC and has chosen to contest it.  The employer must select the language of the letter (English or Spanish), print and give the letter to the employee.  The referral letter explains to the employee the process for resolving a TNC and the steps the employee must take.
