Guilty Pleas in Drug Test Falsification Case

Summary

CDL Staffing, Inc. of Arlington, TX, and its owner, Roy C. Smillie, pleaded guilty in U.S. District Court in Ft. Worth to falsifying drug tests of commercial drivers. CDL Staffing is a temporary staffing agency supplying motor carriers with drivers it certifies as having valid CDLs and current drug tests. Smillie and CDL Staffing were indicted in August 2000 on charges of making false statements to the FMCSA. Smillie admitted that he falsified the drug tests and then supplied "qualified" drivers to various motor carriers. Smillie faces up to 1 year in jail and a fine of $100,000. CDL Staffing could receive a fine of up to $200,000. Sentencing is set for July 23, 2001. The case was referred to OIG by FMCSA for criminal investigation.
