Pennsylvania President of Bridge Construction Firm Pleads Guilty to $121 million DBE Fraud

Summary

On August 28, 2008, Romeo P. Cruz, the owner and operator of Marikina Construction Corporation (MARIKINA), pled guilty in U.S. District Court, Harrisburg, Pennsylvania to criminal conspiracy charges related to a $121 million fraud involving federally funded highway bridge beam construction projects in Pennsylvania. The criminal information alleged that Mr. Cruz and Dennis F. Campbell, former Sales and Marketing Vice President of Schuylkill Product Inc. (SPI), and Timothy G. Hubler, former Vice–President of Field Operations for CDS Engineers Inc (CDS), participated in a DBE pass–through scheme that involved approximately 340 federally funded DBE subcontracts. The Pennsylvania Department of Transportation administered the contracts in question between 1993 and 2007. Both Mr. Campbell and Mr. Hubler have previously pled guilty to criminal charges of conspiracy to commit mail fraud. Sentencing for Mr. Cruz has not been scheduled. DOT/OIG has referred Mr. Campbell, Mr. Hubler, SPI, CDS, and Marikina for suspension and debarment action. We will be referring Mr. Cruz for debarment consideration. This is an ongoing, joint investigation with the Federal Bureau of Investigation, the U.S. Department of Labor–Office of Inspector General, and the Internal Revenue Service–Criminal Investigation Division.
