Additions and Enhancements

Update to 1/1/2004 - The following APIS Policy Topics have been updated to 1/1/2004:

  • Minimum Ages for On-Premises Servers and Bartenders
  • Minimum Ages for Off-Premises Sellers
  • Insurers' Liability for Losses Due to Intoxication ("UPPL")

Functionality Enhancements - Several changes have been made to the site to improve functionality.  The primary change is a new set of menus on the right side of most pages in the APIS Policy Topics section.  These menus provide for easier access to all pages pertaining to a single policy topic as well as related policy topics.  Hyperlinks have been moved from the bottom of these pages.  Because of the extra width needed for maps, charts, and comparison tables, those pages have a different menu structure.

Access to the Comparison Tables of data about State laws and regulations has been modified so that the Explanatory Notes and Limitations no longer appear automatically.  It is strongly recommended that APIS users review all Explanatory Notes and Limitations with care.

New map for Insurers' Liability for Losses Due to Intoxication ("UPPL") - The new map shows the statutory permissibility of denial of health/sickness insurance benefits on the basis of intoxication.  The previous version showed the permissibility of denying benefits for losses due to intoxication under any type of insurance policy.  The revision highlights variation across States with respect to a policy that may have significant implications for public health.

Relevant text excerpts have been added for the District of Columbia, which is now available from the Loislaw legal information service used by APIS.  Some additional excerpts have also been added for the states of Delaware and Washington.

Corrections and Clarifications

In the course of updating policy topics to 1/1/2004, modifications were made to some relevant text excerpts for prior years to increase uniformity of the excerpts on APIS.

Changes to data presented in tables in the APIS Policy Topics section of the Web site are listed below.

Policy Topic Jurisdiction Changes
Insurers' Liability for Losses Due to Intoxication California Changed the coding to indicate that California law does not specifically permit long term care policies to exclude claims arising from intoxication. The previously cited statute permits long term care policies to exclude treatment for alcoholism, a type of insurance exclusion not included in this policy topic. (This change also affects the historical chart for this policy topic.)
Insurers' Liability for Losses Due to Intoxication Maryland Added four regulations. Three of these regulations, effective 10/30/2000, prohibit intoxication exclusions in group health insurance policies, individual and group health maintenance contracts, and individual nonprofit health service plans. The fourth regulation, effective 1/1/2002, prohibits intoxication exclusions in individual hea lth insurance policies. (This change also affects the historical chart for this policy topic.)
Insurers' Liability for Losses Due to Intoxication North Carolina Changed coding to indicate that intoxication exclusions are permitted in accident policies, but not in health insurance policies. (This change also affects the historical chart for this policy topic.)
Underage: Off-Premises Sales Connecticut Changed minimum age of off-premises sellers of wine and spirits from 21 years to 18 years.
Underage: Off-Premises Sales New York Changed minimum age for off-premises sellers of spirits from 21 years of age to 18 years of age.
Underage: Off-Premises Sales North Carolina Changed minimum age for off-premises sellers of spirits from 21 years of age to 18 years of age. Added supporting citations: N.C. Admin. Code tit. 4, r. 2R.1004 and N.C. Gen. Stat. s. 18B-800.
Underage: Off-Premises Sales Vermont This age is governed by Vermont's Liquor Control Board's internal policy and thus not tracked by APIS.
Underage: On-Premises Sales Alabama Added "Manager/Supervisor Present" to the required conditions.
Underage: On-Premises Sales Arkansas Added Ark. Code Ann. s. 3-9-236 to establish the minimum age to bartend.
Underage: On-Premises Sales North Carolina Removed "Manager/Supervisor Present" from among the required conditions.
Underage: On-Premises Sales Oregon Added Jurisdiction Note in order to explain conditions governing employees 18, 19 and 20 years of age.
