Tri Energy et al.

On May 2, 2005, the SEC obtained a temporary restraining order, an asset freeze and other emergency relief in a civil action filed against Tri Energy, Inc., H & J Energy Company, Inc., Marina Investors Group, Inc., Lowell Decker, Robert Jennings, Henry Jones, and Arthur Simburg, as defendants, and La Vie D'Argent, R.P.J. Investment Group, Inc., T.M.A. Investment Enterprises, and Thomas Avery, as relief defendants.  For information about the SEC’s action, you can read Litigation Release Nos. 19214 (May 3, 2005), 19799 (Aug. 10, 2006) and 19907 (Nov. 14, 2006).

The U.S. District Court for the Central District of California appointed Richard Weissman as Receiver to marshal, collect and turn into cash all assets.  On March 21, 2011, the Court entered an Order Approving Distribution Plan and directed the Receiver to determine the lawful claims of investors in Tri Energy. 

If you are an investor in Tri Energy, you should review the Receiver’s Letter, Notice and complete the Proof of Claim Form.  You will need to mail a completed claim form to the Receiver postmarked no later than March 31, 2012.
