Non-recurring Adoption Expenses are reasonable and necessary expenses, up to $2000, which are directly related to the legal adoption of a child and cannot be paid or reimbursed by another source.
To be eligible for non-recurring Adoption Expense reimbursement, the adoptive family must be adopting a child who meets the definition of special needs and have received prior approval for the expenses. Request for reimbursement must be made prior to the finalization of adoption
Examples of expenses covered are: adoption fees, court costs, and attorney fees (only when the adoption cannot be finalized by DFS).

Note: For cases where the child has not been in the custody of the Department of Health and Welfare, Idaho will not cover legal expenses to complete the termination of parental rights. Once parental rights are terminated and a child is legally free for adoption, legal expenses can be applied to the non-recurring adoption expenses reimbursement.

Payments for nonrecurring expenses related to finalizing adoptions for adoptive families is capped at a total of $500 per child for attorney fees and other related legal expenses.

Note: Reimbursement of non-recurring expenses at this upper limit is not automatic. The reimbursement rate is negotiated based on the usual and customary amount paid for “one-time” adoption expenses in that specific region or area.

The amount of the payment made for non-recurring expenses of adoption is determined through agreement between the adopting parent(s) and the placement worker. Nonrecurring expenses cannot exceed $2,000 per child. At the time of the subsidy negotiation, the placement worker provides the family, both verbally and in writing, with the following information about the non-recurring expenses of adoption:
- Non-recurring adoption expenses include reasonable and necessary adoption fees, court costs, attorney fees and other expenses, which are directly related to the adoption of a child with special needs, which have not been reimbursed from other sources
- Costs may include the adoption study, including health and psychological examination, supervision of the placement prior to adoption, transportation and the reasonable costs of lodging and food for the child and/or the adoptive parents when necessary to complete the placement or adoption process
- When siblings are placed and adopted, each child is treated as an individual with separate reimbursement
- For interstate placements, the state that enters into an adoption subsidy agreement is responsible for paying the non-recurring adoption expenses of the child
- The family provides the placement worker original receipts and odometer readings that are forwarded to the subsidy specialist in order to secure reimbursement for pre-placement expenses

$1,200.00 per child for documented actual expenses incurred if the adoption is finalized or $2,000.00 per child can be requested and is considered by OKDHS on a case-by-case basis if an order Terminating Parental Rights or an order Determining the Child Eligible for Adoption Without the Consent of a Biological Parent was necessary for the adoption.

The total amount of reimbursement for non-recurring expenses is based on actual cost and can not exceed $2,000.00 per child per placement.
