Individual Discrimination Complaint Process

Any employee or applicant for employment who feels that he or she has been discriminated against because of race, color, religion, sex, national origin, age (40 or over), disability, or retaliation for prior EEO involvement may file an EEO complaint by contacting an EEO counselor WITHIN 45 CALENDAR DAYS following the alleged discriminatory act. The complainant may have a representative of his or her choice at any stage of an EEO complaint, including the counseling process.

The complainant may choose to participate in RESOLVE, the National Archives' Alternative Dispute Resolution (ADR) program, during the EEO pre-complaint process. RESOLVE offers an alternative informal mediation process geared towards reaching resolution of the issue(s) by the parties themselves.

The EEO counselor will not reveal the identity of the complainant who has come to him or her for consultation, except when authorized to do so by the complainant.
