Securities and Exchange Commission v. Evelyn Litwok and Dalia Eilat, 00-CV-7726 (E.D.N.Y.) (D.L.I.)

On March 3, 2005, the Honorable Dora L. Irizzary granted the Commission's motion for voluntary dismissal of its claim against relief defendant Dalia Eilat, of New York, New York. The Commission's claim was dismissed without prejudice. In its complaint, the Commission sought the return of funds received by Eilat that it alleged were proceeds of fraudulent conduct by defendant Evelyn Litwok against whom the Commission injunctive relief, disgorgement and civil penalties. The Commission moved for dismissal of its claim against Eilat because Eilat obtained a discharge of her Chapter 7 Bankruptcy petition, which she had filed in the United States Bankruptcy Court for the Southern District of New York, extinguishing the Commission's claim against Eilat. The Commission's claims against Litwok are still pending.
