SEC Seeks to Enforce Subpoenas against Oklahoma Resident

On April 8, 2005, the Commission filed an application with the United States District Court for the District of Columbia for an order to enforce investigative subpoenas served on J. Shrewder ("Shrewder"), a.k.a. John Shrewder and Jay Shrewder, a resident of Tulsa, Oklahoma. The subpoenas sought documents and testimony from Shrewder regarding, among other things, statements in a report that he disseminated by fax to members of the investing public. The report concerned ArTec, Inc. and its Tubercin substance. The subpoenas also sought information about Shrewder's trading in ArTec stock.

The Commission's application alleges that Shrewder has not fully complied with the subpoenas issued by the Commission. In its application, the Commission argues, among other things, that Shrewder has no valid basis for his failure to comply. A hearing on the Commission's application has not yet been scheduled.

On December 23, 2004, the Commission issued an Order suspending trading ArTec, Inc. stock for a period of ten days. See Securities Exchange Act of 1934 Release No. 50923 (December 23, 2004).
