Important Pamphlet: For Certain Employment or Education-Based Nonimmigrants (Wilberforce Trafficking Victims Act)

If you are coming to the United States to work or study, we are confident that you will have a pleasant and rewarding stay.  If you should encounter any problems, however, know that you have rights and can get help.  The pamphlet linked below informs you of your rights as a nonimmigrant visa holder in certain employment- and education-based categories (specifically A-3, G-5, NATO-7, B-1 domestic employees, H-1B, H-1B1, H-2A, H-2B, and J-1 visa holders).  The U.S. Government created this pamphlet at the prompting of a new U.S. law, the William Wilberforce Trafficking Victims Protection Reauthorization Act (Public Law 110-457), which reaffirms and strengthens the U.S. Government’s commitment to fight human trafficking and labor abuses in all their forms.

For Visa Applicants in A-3, G-5, NATO-7, B-1 domestic employee, H-1B, H-1B1, H-2A, H-2B, and J-1 categories:  Before your visa interview at the U.S. embassy or consulate abroad, it is important that you take the time to carefully read this pamphlet, as you will be required to have read and understood the pamphlet before being issued a U.S. visa in your category.  In doing so, you will learn about and understand your rights, protections, as well as resources available to you, if help is needed when you come to the U.S.  During your visa interview, the consular officer will make sure you are aware of your legal rights and protections.  After reading the pamphlet, keep it handy for quick reference later, as needed.

Note: In preparing for your visa interview, you will also need to make sure you have all required documentation ready including your completed visa application or application confirmation page.  For detailed application instructions, check the U.S. Embassy website where you will apply for your visa.
