EEO Compliance and Operations Division

The goal of the EEO Compliance and Operations Division (EEOCO) is to ensure every HHS employee/applicant for employment has equal access to EEO services, timely resolution of their complaint and equitable remedy. EEOCO consists of two components: 1) EEO Compliance Team and 2) EEO Operations Team.

The EEO Compliance Team provides leadership, oversight, technical guidance and engages in policy development for the complaint processing units in the HHS Operating Division (OPDIV) EEO Offices. The EEO Compliance Team also manages the EEO Complaint Investigations Program, issues final agency decisions concerning complaints of discrimination, prepares final decisions on Commissioned Corps complaints for the signature of the Surgeon General, processes appeals and remands from the Equal Employment Opportunity Commission (EEOC) and processes conflict of interest cases – i.e., when an EEO Director or staff person pursues a complaint and it would be a conflict for that complaint to be handled in their respective OPDIV EEO office. Further, EEOCO serves as HHS’ liaison with lead agencies such as EEOC, Merit Systems Protection Board (MSPB), Office of Personnel Management (OPM) in matters involving EEO complaint processing.

The EEO Operations Team is the OPDIV EEO Office for the Office of the Secretary (OS), including the Program Support Center and provides the full range of EEO services for the Administration on Aging (AoA), Administration for Children and Families (ACF) and the Substance Abuse and Mental Health Services Administration (SAMHSA). These services include coordinating the assignment of EEO Counselors and mediators, preparing accept-dismissal letters, issuing reports of investigation, transmitting EEO complaint files to EEOC for hearing, etc.

The EEO Operations Team is also responsible for providing/coordinating diversity management/affirmative employment, special emphasis and reasonable accommodation programs. In addition, the EEO Operations Team prepares the Annual Federal EEO Statistical Report on Discrimination Complaints (Form 462 Report) and Management Directive Report (MD-715) on behalf of OS, AoA, ACF and SAMHSA.

Other HHS Operating Division full-service EEO Offices are: Centers for Disease Control, Centers for Medicare and Medical Services, Food and Drug Administration, Health Services and Resources Administration, Indian Health Service and National Institutes of Health.
