Mexican national sentenced to 3 years in prison for illegal reentry

INDIANAPOLIS - A criminal alien, who had been previously deported on two occasions, was sentenced in federal court on Tuesday to three years in prison for illegally reentering the United States after being previously deported as an aggravated felon. This sentence was announced by Timothy M. Morrison, U.S. Attorney for the Southern District of Indiana. It resulted from an investigation conducted by U.S. Immigration and Customs Enforcement's (ICE) Office of Homeland Security Investigations (HSI).

Luis Reyes-Francisco, 27, was sentenced to 36 months in prison Sept. 28 by U.S. District Judge Sarah Evans Barker, Southern District of Indiana, following his guilty plea. Reyes-Francisco pleaded guilty to illegally reentering the United States after being deported as an aggravated felon.

In 2003, Reyes-Francisco was convicted of committing a burglary at a restaurant in Carmel, Ind., and subsequently deported in 2004. Later in 2004, Reyes-Francisco was convicted in the District of Arizona for illegal reentry following an aggravated felony conviction and sentenced to 18 months. He was again deported in 2006 after serving his prison sentence.

Reyes-Francisco was encountered at a residence in Indianapolis on March 26 and this prosecution resulted. He will be deported again to Mexico upon completion of his 36-month prison sentence. Reentering the United States after being formally deported is a felony punishable by up to 20 years in prison.
