This document originates from a case concerning the efforts of the Ku Klux Klan to interfere with passenger travel and obstruct free movement of interstate commerce through and in Alabama. The Court with Judge Frank M. Johnson, Jr. presiding, found that although the Montgomery, Alabama, Police Department was notified May 20, 1961, that a bus carrying a group of "white and Negro college students" (the so-called Freedom Riders) was traveling from Birmingham to Montgomery, no precautionary measures were taken by the Montgomery Police Department to prevent violence upon the arrival of the bus. The Court concluded that this failure to enforce the law amounted to a violation of the Equal Protection Clause of the Fourteenth Amendment. The Court also issued a temporary restraining order against the Congress of Racial Equality, the Southern Christian Leadership Conference, and others acting with them, to prevent obstruction of interstate commerce caused by non-bona fide trips.
