HHS Awards 106 Annual Benefit Waivers; 8th U.S. Circuit Court of Appeals to Hear Health Reform Case in October

From SAMHSA's Weekly Financing News Pulse: National Edition - August 26, 2011: In July, U.S. Department of Health and Human Services (HHS) officials awarded 106 waivers exempting health plans from the health reform’s annual benefit limit requirement, bringing the total number of waivers to 1,472.  HHS will stop accepting waiver applications on September 22; however, waivers granted or renewed by September 22 will run through 2013.  In other health reform news, on August 23, the 8th U.S. Circuit Court of Appeals announced plans to hear oral arguments in Missouri Lieutenant Governor Peter Kinder’s (R) challenge of the national health care reform law during the week of October 17.  Originally filed last July in U.S. District Court, Lieutenant Governor Kinders’ suit contends that the law’s individual insurance mandate is unconstitutional, the law’s expansion of Medicaid could force Missouri to raise state taxes, and the law improperly alters state officials’ compensation by changing their health care plan.  The 11th U.S. Circuit Court of Appeals recently rejected the law’s legality, while the 3rd and 6th U.S. Circuit Courts of Appeals have upheld it.

Four States Form Prescription Drug Abuse Task Force

From SAMHSA's Weekly Financing News Pulse: National Edition - August 26, 2011: Ohio, Kentucky, Tennessee, and West Virginia have formed a task force to combat prescription drug abuse through increased enforcement, treatment, and prevention activities.  Under the Interstate Prescription Drug Task Force, each state will maintain its own prescription drug monitoring program (PDMP) data but share it with other states upon request.  The task force will focus on treatment, law enforcement, education, and monitoring.  Groups of experts will devise policy recommendations for each focus area by this fall.

HHS, DOI, and DOJ Create a New Federal Framework to Coordinate Tribal Substance Abuse Programs

From SAMHSA's Weekly Financing News Pulse: National Edition - August 12, 2011: On August 5, U.S. Department of Health and Human Services (HHS) Secretary Kathleen Sebelius, U.S. Department of Interior (DOI) Secretary Ken Salazar, and U.S. Attorney General Eric Holder announced a new federal framework to coordinate substance abuse prevention and treatment among American Indian and Alaskan Native communities.  Called for under the Tribal Law and Order Act of 2010, which President Obama signed in July 2010, the Memorandum of Agreement (MOA) describes how an inter-departmental coordinating council will guide the new federal effort while the U.S. Substance Abuse and Mental Health Administration’s (SAMHSA) Office of Indian Alcohol and Substance Abuse will coordinate tribal substance abuse programs at the federal level.

CMS to Launch Medicaid Demonstration Project Expanding Mental Health Coverage

From SAMHSA's Weekly Financing News Pulse: National Edition: August 5, 2011: On August 9, Centers for Medicare & Medicaid Services (CMS) officials announced a $75 million three-year Medicaid demonstration project that will examine the impact of covering mental health treatment in psychiatric hospitals with more than 17 beds.  Often referred to as “institutions of mental disease” (IMDs), Medicaid does not currently fund treatment at such facilities for individuals aged 21 to 64.  Created and funded under national health care reform, the demonstration project is designed to examine the quality of care that patients receive at such facilities, their effect on emergency room utilization, and the overall cost-effectiveness of such care.  All states may apply for the program; however, CMS only plans to accept a “limited number."

3rd U.S. Circuit Court of Appeals Rejects Health Reform Suit

From SAMHSA's Weekly Financing News Pulse: National Edition - August 5, 2011: On August 3, the 3rd U.S. Circuit Court of Appeals rejected non-profit New Jersey Physicians Inc.’s  The non-profit and one of its patients filed the suit in March 2010, alleging that the law would prevent physicians from directly accepting patient payments.  However, in December 2010, U.S. District Court Judge Susan Wigenton rejected the suit on the grounds that the law does not preclude direct payment acceptance.  In considering the appeal, the appellate court ruled that the organization failed to adequately demonstrate a concrete or actual injury.  appeal in their lawsuit challenging the national health care reform law.

SAMHSA Awards NASADAD $1.1 Million for Block Grant Assistance

From SAMHSA's Weekly Financing News Pulse: National Edition - August 5, 2011: On July 29, the Substance Abuse and Mental Health Services Administration (SAMHSA) awarded the National Association of State Alcohol and Drug Abuse Directors (NASADAD) a $1.1 million grant to support states administering SAMHSA’s Substance Abuse Prevention and Treatment Block Grants.  Under the grant, NASADAD will provide technical assistance to substance abuse Single State Agencies (SSAs) to increase service capacity, facilitate care integration, and improve health outcomes.  In addition, NASADAD will assist states in improving information technology (IT) capabilities, implementing evidence-based practices, and responding to new health care challenges, including implementation of health care reform and Mental Health Parity and Addiction Equity Act (MHPAEA).
