Re: Withdrawal of June 2005 Center for Regulatory Effectiveness Request for Reconsideration on Atrazine
Dear Mr. Tozzi:
I am writing in response to your December 16 letter to withdraw the Request for Reconsideration dated December 16, 2005, which you submitted on behalf of the Center for Regulatory Effectiveness (CRE). This Request appealed the agency’s May 25, 2005 decision to deny CRE’s request for correction. As you asked, we have withdrawn the Request for Reconsideration.
As you know, the National Institutes of Health "Guidelines for Ensuring the Quality of Information Disseminated to the Public" provide that Requests for Reconsideration may be submitted only within 30 days of the agency’s decision regarding a request for correction. Consequently, CRE is unable to re-submit its Request for Reconsideration in this matter, and any future concerns regarding the document at issue, or subsequent documents, will need to be addressed in separate requests for correction. I spoke yesterday with your associate, Scott Slaughter, who confirmed CRE’s understanding that it will be unable to re-submit the request for correction in this case.
