FDA Tobacco Retail Inspection Contracts

The Family Smoking Prevention and Tobacco Control Act authorizes FDA to contract with States, U.S. territories and Indian tribes to assist with compliance and enforcement activities to help limit the availability of tobacco products to youth. FDA issues requests for proposals (RFPs) to assist with inspections of retail establishments and other enforcement activities to help enforce the Regulations Restricting the Sale and Distribution of Cigarettes and Smokeless Tobacco to Children and Adolescents that took effect on June 22, 2010.

FDA awarded contracts to 15 states in 2010 and 38 states, including the District of Columbia, in 2011 and plans to award additional contracts in fiscal year 2012. We hope to contract with every state and U.S. territory to assist with FDA’s tobacco retail inspection effort, so there will be additional opportunities to contract with FDA. 

We look forward to working with all states, U.S. territories, and Indian tribes in our shared efforts to reduce youth access to, and use of, cigarettes, cigarette tobacco, and smokeless tobacco.

 

FY 2012 Solicitation

The U.S. Food and Drug Administration (FDA) intends to award contracts to additional states and territories to assist in inspecting retail establishments that sell cigarettes, cigarette tobacco, and/or smokeless tobacco products and in surveillance of other entities that fall under the scope of the provisions cited in the Fiscal Year 2012 Request for Proposals - State Tobacco Enforcement. The solicitation and all subsequent updates can be found on Federal Business Opportunities (FedBizOpps) website, where the federal government posts acquisition opportunities.
 
States that were awarded contracts in FY2011 should not submit additional proposals. This solicitation is only for states and territories not currently under contract with FDA.
