A BILL
To prevent the shutdown of the Federal Government.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Government Shutdown
4
Prevention Act’’.
5
SEC. 2. AMENDMENT TO TITLE 31.
6
(a) I
N
G
ENERAL
.—Chapter 13 of title 31, United
7
States Code, is amended by inserting after section 1310
8
the following new section:
9
‘‘§1311. Continuing appropriations
10
‘‘(a)(1) If any regular appropriation bill for a fiscal
11
year (or, if applicable, for each fiscal year in a biennium)
12

does not become law before the beginning of such fiscal
1
year or a joint resolution making continuing appropria-
2
tions is not in effect, there are appropriated, out of any 
3
money in the Treasury not otherwise appropriated, and
4
out of applicable corporate or other revenues, receipts, and
5
funds, excluding any budget authority designated as an
6
emergency or temporary funding for projects or activities
7
that are not part of ongoing operations, to such sums as
8
may be necessary to continue any project or activity for
9
which funds were provided in the preceding fiscal year—
10
‘‘(A) in the corresponding regular appropriation
11
Act for such preceding fiscal year; or
12
‘‘(B) if the corresponding regular appropriation
13
bill for such preceding fiscal year did not become
14
law, then in a joint resolution making continuing ap-
15
propriations for such preceding fiscal year.

‘‘(2) Appropriations and funds made available, and
17
authority granted, for a project or activity for any fiscal
18
year pursuant to this section shall be at a rate of oper-
19
ations not in excess of the lower of—
20
‘‘(A) the rate of operations provided for in the
21
regular appropriation Act providing for such project
22
or activity for the preceding fiscal year; or
23
‘‘(B) in the absence of such an Act, the rate of 
24
operations provided for such project or activity pur-
25

suant to a joint resolution making continuing appro-

priations for such preceding fiscal year.

‘‘(3) Appropriations and funds made available, and
3
authority granted, for any fiscal year pursuant to this sec-
4
tion for a project or activity shall be available for the pe-
5
riod beginning with the first day of a lapse in appropria-
6
tions and ending with the earlier of—
7
‘‘(A) the date on which the applicable regular
8
appropriation bill for such fiscal year becomes law
9
(whether or not such law provides for such project
10
or activity) or a continuing resolution making appro-
11
priations becomes law, as the case may be; or
12
‘‘(B) the last day of such fiscal year.
13
‘‘(4) This section shall not provide funding for a new
14
fiscal year to continue any project or activity which is
15
funded under the provisions of this section at the end of 
16
the preceding fiscal year until the enactment of a regular
17
appropriation Act or joint resolution making continuing
18
appropriations for such project or activity during such new
19
fiscal year.

‘‘(b) An appropriation or funds made available, or au-
21
thority granted, for a project or activity for any fiscal year
22
pursuant to this section shall be subject to the terms and
23
conditions imposed with respect to the appropriation made
24
or funds made available for the preceding fiscal year, or
